Terms of Use

1. Using Bendlo

Bendlo is a puzzle game made for adults. If you are under the age of majority where you live, you may use Bendlo only with the permission of a parent or guardian, who agrees to these terms for you.

2. Your licence

We give you a personal, non-exclusive, non-transferable, revocable licence to use Bendlo for your own non-commercial entertainment on devices you own or control, as allowed by the app store you downloaded it from. You may not:

• copy, sell, rent or redistribute Bendlo or its puzzles;
• reverse engineer, decompile or modify the app, except where the law allows this despite this restriction;
• use bots, scripts or automated tools to play, collect puzzles or submit results;
• interfere with our servers or try to access data that isn’t yours.

3. Bendlo Plus and purchases

• Bendlo Plus is a one-time purchase, not a subscription. It currently includes no ads, unlimited hints, two streak freezes per month, all colour themes and the daily puzzle archive. If we change what Plus includes, we won’t take away its core benefit of no ads.
• Purchases are made and paid for through the Apple App Store or Google Play, under their terms. Refund requests are handled by Apple or Google under their policies. This does not affect any refund or cancellation rights the law gives you.
• Bendlo Plus is linked to your app store account. Use Restore purchase in Settings to get it back on a new device signed in to the same store account.
• Prices are shown in the app store before you buy and may differ by country. Taxes are added where required.

4. Ads and hints

The free version of Bendlo shows ads. Rewarded videos are always optional. Ads are provided by third parties, and we are not responsible for the products or services they advertise.

Hints, streaks, streak freezes and other in-game items have no cash value, cannot be sold, transferred or exchanged for money, and may be adjusted as we balance the game.

5. Groups, nicknames and fair play

Groups and leaderboards are not in the app yet. When they arrive, these rules apply. If you create or join a group, the nickname, avatar colour and group name you choose are shown to the members of your groups. You agree that your nickname and group names will not be offensive, hateful, sexual, misleading or impersonate someone else, and will not include other people’s personal information. You give us permission to store and display them to your group members so the feature can work.

Please play fair. We may reject results that look automated or impossible, remove or change nicknames or group names that break these terms, limit how often invite codes can be used, and remove players from groups or leaderboards to protect other players.

6. Your account and data

Bendlo works without sign-up, and your progress is saved only on your device. If you uninstall the app, lose your device or reset it, your progress will be lost, and we cannot recover it. Bendlo Plus is not lost: use Restore purchase. When online features arrive, you will be able to back up your progress and delete online data in Settings → Delete my data. Our Privacy Policy explains how we handle your information.

7. Our content

Bendlo, including its puzzles, design, artwork, sounds, software and the Bendlo name, is owned by Pyliq Software Inc. or our licensors and is protected by intellectual property laws. Fonts and other third-party materials are used under their own licences. These terms do not give you any rights to our trademarks. If you send us ideas or feedback, we may use them freely, without owing you anything.

8. Other services

Bendlo relies on services from other companies, such as app stores, ad networks and sign-in providers. Your use of those services is covered by their own terms and privacy policies.

9. Changes to Bendlo

We keep improving Bendlo, so features, puzzles and difficulty may change. We may add, change or remove features, and some features (such as groups) may not be available in every country or at all times. Online features need an internet connection and may sometimes be unavailable. If we ever stop offering Bendlo, we will try to give you reasonable notice.

10. Disclaimer

We work hard to make Bendlo reliable and fun, but it is provided “as is” and “as available”. To the fullest extent the law allows, we do not promise that Bendlo will be uninterrupted, error-free, or that your progress will never be lost, and we disclaim implied warranties such as merchantability and fitness for a particular purpose. Some places do not allow these exclusions, so they may not apply to you.

11. Limit of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential losses, or for loss of data, progress or streaks, arising from your use of Bendlo. Our total liability to you for all claims is limited to the greater of the amount you paid for Bendlo in the 12 months before the claim and CAD $10.

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, for deliberate misconduct or gross negligence, or anything else that cannot be limited by law. Nothing in these terms affects rights you have under consumer protection laws that cannot be waived, such as those in Quebec, the European Union and the United Kingdom, including your legal rights if digital content is faulty.

12. Ending these terms

You can stop using Bendlo at any time by uninstalling the app. We may suspend or end your access to online features if you seriously or repeatedly break these terms. Sections that by their nature should continue (such as 7, 10, 11, 13 and 16) continue after these terms end.

13. Governing law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, and disputes may be brought in the courts of British Columbia. If you live elsewhere, you keep any protections that the laws of your home country, province or state give you and that cannot be changed by agreement, and you may bring a claim in your local courts where the law allows. Before going to court, please contact us: most problems can be sorted out quickly.

14. Extra terms for Apple devices

If you downloaded Bendlo from the Apple App Store:

• These terms are between you and Pyliq Software Inc., not Apple. Apple is not responsible for Bendlo or its content.
• Your licence is limited to Apple-branded devices you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide maintenance or support for Bendlo.
• If Bendlo fails to meet a warranty that applies, you may notify Apple, and Apple will refund the purchase price (if any). To the extent the law allows, Apple has no other warranty obligation for Bendlo.
• Apple is not responsible for any claims relating to Bendlo, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
• If someone claims that Bendlo infringes their intellectual property, we, not Apple, are responsible for dealing with that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or listed on a U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

15. Changes to these terms

We may update these terms from time to time. We will post the new version here with a new effective date and, for important changes, let you know in the app before they take effect. If you keep using Bendlo after that, the new terms apply.

16. General

These terms and the Privacy Policy are the whole agreement between you and us about Bendlo. If a court finds part of these terms unenforceable, the rest still applies. If we don’t enforce a term right away, we can still enforce it later. We may transfer these terms to a company that takes over Bendlo, and your rights under them stay the same. You may not transfer them.
